Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Clarity Health PLLC website and your enrollment in any Clarity Health membership or services. By accessing our website, requesting a consultation, or enrolling as a member, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our website or enroll in our services. These Terms apply in addition to any separate Membership Agreement you sign upon enrollment.
Important: These Terms do not create a physician-patient relationship. A physician-patient relationship is only established after you complete our enrollment process, sign a Membership Agreement, and are formally accepted as a patient by Clarity Health PLLC.
Description of Services
Clarity Health PLLC is a direct primary care and longevity medicine practice operating in West Virginia. We offer membership-based medical services focused on proactive, preventive, and longevity medicine for adults.
Our services include, depending on membership tier:
- Comprehensive longevity medical evaluations and annual exams
- Advanced biomarker testing and lab interpretation
- Personalized health and longevity planning across five pillars
- Telehealth and in-person visits
- Secure physician messaging
- Hormone optimization and metabolic health protocols
- Wearable technology integration and health coaching
- Specialist care coordination
Specific services vary by membership tier. All services are subject to clinical appropriateness as determined by your physician. The scope of services is detailed in your Membership Agreement.
Clarity Health is a direct pay practice. We do not bill insurance for membership fees. Patients are responsible for all membership fees as outlined in their Membership Agreement. Certain ancillary services (laboratory testing, medications, devices) are billed separately and are not included in membership fees.
Not Emergency Care — Critical Notice
Clarity Health does not provide emergency medical services. In the event of a medical emergency, call 911 or go to your nearest emergency room immediately. Do not attempt to contact Clarity Health as your first response to a medical emergency.
Our services are designed for proactive, preventive, and ongoing chronic care management — not for acute medical emergencies. While we strive to be accessible to our patients, response times for messages and calls may vary and cannot be guaranteed in life-threatening situations.
Even for Concierge tier members with direct physician access, you should not rely on Clarity Health for emergency medical care. Always call 911 for life-threatening emergencies.
Membership Terms
Clarity Health offers three membership tiers: Longevity Foundation, Longevity Optimized, and Longevity Concierge. Each tier has a defined scope of services, patient panel limit, and annual fee as described on our website and in your Membership Agreement.
Enrollment
Membership enrollment requires completion of an intake process, execution of a Membership Agreement, and payment of the applicable membership fee. Enrollment in the Concierge tier is by application only and is subject to physician approval and panel availability.
Founding Member Pricing
Patients who enroll during the founding member period and maintain continuous active membership are entitled to locked-in pricing at their initial enrollment rate for so long as their membership remains active and in good standing. This pricing guarantee applies to the base membership fee only and does not apply to ancillary services, medications, laboratory testing, or devices, which are billed separately.
Panel Limits
Each membership tier has a maximum panel size. We reserve the right to close enrollment at any tier when the panel maximum is reached. Waitlist options may be available.
Geographic Limitations
Clarity Health is licensed to practice medicine in West Virginia. Telehealth services are available to patients physically located in West Virginia at the time of the visit. In-person services are available at our Shepherdstown, WV location. Home visits are available to Concierge members within our defined service area in West Virginia.
Payment & Billing
Membership fees are billed annually at the beginning of each membership year. We accept major credit cards, debit cards, and ACH bank transfers. Health Savings Account (HSA) and Flexible Spending Account (FSA) funds may be used for qualifying medical services — consult your plan administrator for eligibility.
Membership fees cover the defined scope of services for each tier. The following are billed separately and are not included in membership fees:
- Laboratory and diagnostic testing
- Prescription medications and supplements
- Wearable devices and health technology
- Specialist referrals and outside services
- Imaging and procedures
All ancillary charges will be communicated transparently before orders are placed. You will not receive a surprise bill for services not previously discussed.
Membership fees are not reimbursable by insurance. However, you may submit receipts for ancillary medical services to your insurance for potential out-of-network reimbursement. We will provide documentation to support such claims upon request.
Cancellation Policy
Cancellation by Patient
You may cancel your membership at any time with 30 days' written notice. Upon cancellation, your membership and associated services will terminate at the end of the current paid membership period. Membership fees are generally non-refundable, except as required by applicable law or in cases of:
- Relocation outside of West Virginia making it impractical to receive services
- Physician-initiated termination of the membership at Clarity Health's discretion
- Practice closure or material change in services
Founding member locked-in pricing is forfeited upon cancellation. Re-enrollment after cancellation will be at prevailing rates at that time, subject to panel availability.
Termination by Clarity Health
Clarity Health reserves the right to terminate a patient's membership for reasons including but not limited to: non-payment of fees, abusive or threatening behavior toward staff, misuse of services, or clinical circumstances that make the relationship no longer appropriate. In such cases, we will provide reasonable notice and appropriate referrals to ensure continuity of care.
Patient Obligations
As a patient of Clarity Health, you agree to:
- Provide accurate, complete, and current health and personal information
- Notify us promptly of any changes to your health status, medications, or contact information
- Pay all membership fees and ancillary charges when due
- Use our services for legitimate health and medical purposes only
- Treat all Clarity Health staff with respect and professionalism
- Follow through with agreed-upon care plans or communicate if you cannot
- Maintain active engagement with your care, including wearable tracking and follow-up appointments as recommended
- Maintain insurance or alternative means to cover emergency, hospital, specialist, and ancillary care costs not covered by your membership
Clarity Health membership is not a substitute for comprehensive health insurance. We strongly recommend that all patients maintain health insurance, catastrophic coverage, or a healthcare sharing plan to cover services outside the scope of your membership.
Limitations of Liability
Nothing in these Terms limits Clarity Health's liability for medical malpractice or professional negligence. Physicians are personally liable for their own acts of professional malpractice under West Virginia law.
To the fullest extent permitted by applicable law, Clarity Health's liability for any non-malpractice claims related to website use, membership administration, or business operations shall not exceed the total membership fees paid by you in the twelve months preceding the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, except where such limitation is prohibited by applicable law.

The information on our website is for general informational purposes only and does not constitute medical advice. Reliance on any information provided on our website is solely at your own risk. Website content does not create a physician-patient relationship.
Intellectual Property
All content on the Clarity Health website — including text, graphics, logos, images, and design elements — is the property of Clarity Health PLLC or its licensors and is protected by applicable intellectual property laws.
You may access and view our website content for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law principles. Any legal action arising from these Terms shall be brought exclusively in the courts of Jefferson County, West Virginia, or in the United States District Court for the Northern District of West Virginia, and you consent to the personal jurisdiction of such courts.
Dispute Resolution
Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through mediation as a first step, before litigation.
Nothing in this section limits either party's right to seek emergency injunctive or equitable relief from a court of competent jurisdiction when necessary to prevent immediate harm.
Medical malpractice claims are governed by West Virginia law and are not subject to the dispute resolution provisions above.
Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated to active members via email with at least 30 days' notice before taking effect. Non-material changes (such as clarifications or corrections) may be made without notice and will be effective upon posting.
Your continued use of our services after notice of material changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you may cancel your membership as described in our Cancellation Policy.
